A $125,000 settlement was obtained by Alex Kemeny for a client who sustained a broken tibia and fractured rib when she tripped at a local movie theater.
The case was settled once it was called in for trial at the Middlesex County Superior Court and Mr. Kemeny appeared with the client ready to try the case. Prior efforts to resolve the case had been unsuccessful.
At the time of the accident, the client was 2.5 weeks post a knee surgery and proceeding down the theater's stairs when she tripped, breaking the tibia in her right leg and fracturing a rib against a crutch. No surgery was required for the injuries.
At the time of the accident, the theater lights did not turn up when the audience was leaving and the plaintiff's engineering expert found that the stairs were not properly constructed. The movie theater contested liability, claiming that it was the plaintiff who was primarily responsible for the accident.
